FIFTH ORDER OF BUSINESS SOLitude Lake Management
Bryan Encarnacion of SOLitude was introduced and advised that he would be assuming responsibility as District Manager for the District.
A. Monthly Reports and Observations
i. Lake Management Report
Brooke Bledsoe reviewed the lake management report and reported that treatments had been performed for pond weed and spatterdock. Chair Hubbard requested that future reports identify personnel on site and the dates of service. The Board also agreed that communications with SOLitude should be coordinated through Ms. Bledsoe, who would communicate with the appropriate members of the SOLitude team.
Chair Hubbard shared photographs of areas where bacopa had been inadvertently impacted during treatment activities and emphasized the importance of targeted applications and continued technician training due to the value and limited availability of the plant. SOLitude representatives discussed the matter and agreed to follow up on the concern.
Chair Hubbard also discussed vegetation growth within Lake 19 near the aqua range area and noted that this lake should remain free of littoral plantings due to golf ball activity. SOLitude was asked to address the growth of spike rush and other vegetation in that area.
ii. Lake Treatment Reports
B. Enhanced Water Body Assessment-October 2026
Supervisor Soucie reported that he had not received a response from Zachary of SOLitude regarding the scheduling of the water quality testing planned for the week of October 5, 2026. The Board was advised that the sampling bottles had been shipped and were expected to arrive shortly. Bryan Encarnacion stated that he would follow up with Zachary and coordinate with Supervisor Soucie to schedule the testing.
C. Littoral Shelf Planting and Refurbishment Proposal
Chair Hubbard discussed the proposed littoral shelf planting project and confirmed with Ms. Bledsoe that the work area was located to the right of the main gate. Mr. Encarnacion explained that the spike rush plantings would be installed in clusters of approximately 500 plants rather than in a continuous line and would be spaced along the shoreline. Chair Hubbard recommended focusing the planting efforts on the areas east and west of the canal that are most visible to residents. Mr. Encarnacion further noted that installation would likely be delayed until April or May to allow water levels to recede.
Mr. Encarnacion discussed various flowering plants used by SOLitude, including cannas, pickerelweed, arrowheads, and swamp lilies. Hybrid cannas were also discussed but were not recommended due to their higher cost and limited availability. It was also noted that the canna plantings at Lake 13 were performing well.
Chair Hubbard requested that SOLitude provide the proposal and future updates electronically to Compliance Manager Gindling for review once dates and pricing have been confirmed.
On MOTION by Chair Hubbard, seconded by Vice Chair Arcurie, with all in favor, the Board approved the SOLitude proposal for the planting of 9,000 Spike Rush in the amount of $6,950 to be planted in clusters of 500 in the littoral shelf along the banks of Lake 30B by May, 2027.
Brooke Bledsoe and Bryan Encarnacion left the meeting at 9:30 AM.
SIXTH ORDER OF BUSINESS Attorney
There was no Attorney report.
SEVENTH ORDER OF BUSINESS Old Business
A. Golf Courses Renovation Update
Chair Hubbard reported that there was no significant update at this time, as the project had not yet received final approval. Homeowners are expected to be informed of the project at the next homeowners meeting in November 2026, and the project is anticipated to begin in February 2028. The District is expected to be responsible for the cost of the lake bank rebuild, with a cost estimate anticipated in November.
B. Parking Lot Renovation Planning
Supervisor Bachenberg reported that he had been coordinating with Doug Brown regarding the community parking lot project. An estimate of $1,260 was received for sealcoating, patching, and striping; however, the proposal was not itemized. Although the cost appeared lower than expected, Doug Brown advised that project scheduling and scope coordination had been assigned to Kevin.
Supervisor Bachenberg stated that he would confirm with Kevin that all required work was included in the proposal and repairs are anticipated to occur in the fall. Supervisor Bachenberg further noted that a complete mill and overlay of the Heritage Bay roadways is anticipated in 2033.
District Manager Teague requested that a final copy of the proposal, including the scope of work, be provided and forwarded to Assistant District Manager Gindling for District records.
On MOTION by Supervisor Bachenberg, seconded by Supervisor Dubester, with all in favor, the Board approved the parking lot renovation at a not-to-exceed cost of $3,000.
Supervisor Bachenberg confirmed that he voted in favor of all motions, noting that technical difficulties affected communication during the meeting.
C. Infrastructure and Facilities Management Report
Chair Hubbard explained that the Infrastructure and Facilities Management Report was developed to track District projects and priorities using a color coded system and to assist with long-term planning. He noted that the report is generally updated on a quarterly basis. Staff was directed to provide the report to Field Manager Pepin for reference and coordination purposes.
Chair Hubbard reviewed the following projects in the report:
- Lake 9: Bank sloughing is being monitored due to limited drainage.
- Lake 10: Lake bank reconstruction for 11 homes is planned for summer 2027.
- Lakes 14, 15, and 16: Washout repairs will likely be deferred until after the golf course renovation project.
- Lake 6: Washout repairs near the pool area are expected to be completed with upcoming lake bank restoration work.
- Lake 20: Erosion improvements are planned in conjunction with future lagoon work.
Chair Hubbard reviewed completed and planned infrastructure projects, noting approximately $149,125 in completed projects and $200,075 in planned projects for 2027. He reported that approximately $32,825 remained available in the budget prior to approval of the littoral planting project. The Board also discussed lake bank washouts that occurred during the summer, with Chair Hubbard noting that the Club should have a role in maintaining affected areas and that additional restoration efforts would be evaluated in the future golf course renovation project.
i. Draft of Community Engagement Letter
Supervisor Dubester reported that he met with the community communications team to discuss increasing awareness of CDD activities. As a result, upcoming CDD meetings will be included in the community’s weekly email newsletter prior to each meeting.
The Board discussed developing a succession plan for Supervisor positions, including the possibility of forming a subcommittee to engage with interested residents and assess their level of interest. District Manager Teague also suggested maintaining a list of potential candidates who could be contacted when Board vacancies occur.
The Board reviewed the draft letter and recommended adding information highlighting the benefits of the CDD, including proactive maintenance, exemption from sales tax on District purchases, and the use of non-ad valorem assessments to fund improvements rather than special assessments.
Supervisor Dubester reported that the District had been approved to host a booth at the upcoming community meet-and-greet event and stated that he would prepare a draft letter for review by Staff and the Board for inclusion in the next community email blast.
Chair Hubbard asked whether the community engagement letter could be mailed to registered voters within Heritage Bay. Staff was directed to follow up with the County to determine whether a list of registered voters is available.
ii. Draft of Resident Tours Website Page
Chair Hubbard noted that he would appreciate the Supervisors’ help in performing future District tours. He noted that he has a list that he goes through during tours and that this topic can be tabled until a later date.
EIGHTH ORDER OF BUSINESS New Business
A. Lake 14: Lake Interconnect Control Structures
Chair Hubbard reported concerns regarding water flow between Lakes 13, 14 and 20, noting that irrigation water being pumped into Lake 14 appears to be flowing into Lake 20.
Supervisor Soucie explained that the water is not being lost from the system but is moving through the interconnected lakes as water levels equalize.
Chair Hubbard reported that Kevin met with Blueshore Engineering to review the drainage issue and that a recommendation was made to install a Type C control structure in Lake 14 to eliminate the need for sandbags between Lakes 13 and 20. The proposed improvements will be subject to review and approval by District Engineer Seger prior to construction.
B. Coach Homes 2: Drainage Installation Request
On MOTION by Chair Hubbard, seconded by Vice Chair Arcurie, with all in favor, the Board of Supervisors of Heritage Bay Community District Development approved the requirement for Coach Homes 2 to install proper drainage from 19 of their 22 buildings, buildings 10482 to 10554, consistent with ongoing CDD engineering standards, practices and requirements, to properly maintain and protect the District’s stormwater system. All subject drainage to be installed in 2027 per proposal from Copeland Southern Enterprises, Inc. The 3 buildings on Lake 30A (10568-10576) do not require drainage installation.
Chair Hubbard reviewed prior Board discussions regarding drainage improvements for the Coach Homes 2 buildings. He noted that the Board had previously expressed concerns about proposals to add 12-inch extensions to downspouts, as doing so could discharge water closer to the lake banks. As a result, the CDD deferred making a recommendation until the developer submitted a drainage plan for review.
Chair Hubbard also discussed ongoing drainage improvement efforts throughout the community, noting that all Terraces buildings have been completed, Verandas are expected to be completed by next summer, and only approximately 20 single family homes will remain. He stated that all Coach Homes are anticipated to be completed by the end of next summer. It was noted that three of the Coach Homes 2 buildings had previously been plumbed.
Staff should confirm that the master stormwater guidelines document developed with Greg Urbancic and Gregor Vance is in the District’s files. Chair Hubbard stated that he would follow up with Ken Bruchanski regarding the Board’s decision requiring drainage improvements for 19 of the 22 Coach Homes 2 buildings.
NINTH ORDER OF BUSINESS District Manager
District Manager Teague reported that the District’s insurance policy had been renewed. He also reminded Supervisors of Sunshine Law requirements, emphasizing that Board members should avoid discussing District business outside of publicly noticed meetings and exercise caution when communicating by email.
Additionally, he announced that Len Tosto had been selected as the new District Manager following an extensive recruitment process and noted that he brings significant experience to the position.
TENTH ORDER OF BUSINESS Supervisors Requests
Supervisor Dubester expressed concern that desirable plants, including bacopa, had been damaged during recent treatment activities and questioned whether SOLitude should be responsible for replacing them.
Chair Hubbard stated that he would prepare a letter to SOLitude expressing the Board’s concerns and requesting a response outlining measures that will be taken to prevent similar issues in the future.
District Manager Teague suggested that Chair Hubbard recommend SOLitude consider using backpack sprayers in sensitive areas to allow for more targeted treatments and help reduce impacts to desirable vegetation while still addressing algae and aquatic growth.
ELEVENTH ORDER OF BUSINESS Chairman Comments
Chair Hubbard reported that he would be meeting with Copeland Southern Enterprises to review an area along Lake Bank 15 where grading issues have caused stormwater to flow toward nearby homes and lanais. He noted that a 2015 survey identified deficiencies in the area during the original development.
Chair Hubbard also advised that a new EPA supplemental rule had been forwarded to District Engineer Seger for review.
